GRÚAS SÁEZ, S.L., the „Seller“, guarantees the new cranes purchased by the Buyer, under the terms and conditions detailed below, hereinafter referred to as the „Terms“, which regulate the rights and obligations of the parties in relation to the guarantee, compliance with which is a requirement for its validity.
1 . PURPOSE AND SCOPE OF THE WARRANTY
1.1. The Seller guarantees to the Buyer that the new crane purchased by the Buyer is in perfect working order and is therefore free from any defects in materials and workmanship and in optimum working condition, in accordance with the agreed technical specifications.
1.2 The guarantee is limited exclusively to the repair or replacement, at the Seller’s choice, of those parts of the crane which, during the guarantee period, prove to be defective due to faults in materials or workmanship, provided that the crane is used and maintained in accordance with the manufacturer’s instructions. All other costs arising from the replacement of the parts covered by this warranty shall be borne by the Buyer.
1.3 Therefore, costs related to transportation, disassembly, assembly or other expenses not approved in writing by the Seller are expressly excluded from coverage under this warranty; however, the Seller may, at their option, reimburse reasonable shipping and labour costs incurred for previously authorised repairs, always in writing, after individualised evaluation.
2 . WARRANTY PERIOD.
a) Twelve (12) months from the date of receipt by the Seller of the „Crane Commissioning Check List“ document, duly completed by the Buyer. This document should be sent to warranty@gruassaez.raanet.es within a maximum period of two (2) months from the invoice date of the crane. If not received in time, the guarantee shall be deemed to have started automatically on the date of the sales invoice, but shall not become effective until the aforementioned document is presented.
b) The use of the crane for a total of two thousand four hundred (2,400) hours of operation, according to the equipment log.
3. CONDITIONS FOR THE APPLICATION OF THE WARRANTY.The validity of the warranty shall be subject to the Buyer’s compliance with the following conditions:
a) Strictly comply with the „Warranty Technical Assistance Procedure“ in force.
b) Submit the „Crane Commissioning Check List“ within the time limit stipulated in section 2.1 point a).
c) Notify the Seller in writing of any defect or malfunction within seven (7) days of discovery, and always within the
warranty period.
d) Allow repairs or replacements to be carried out only by personnel authorised by the Seller.
e) Ensure that the crane has been operated and maintained in accordance with the manual provided by the Seller.
4. WARRANTY EXCLUSIONS. The warranty shall not apply in the following cases:
a) Natural wear and tear resulting from ordinary use of the crane, including but not limited to seals, gaskets, hoses, wire
ropes, filters and external coatings.
b) Repairs, modifications or alterations to cranes carried out by personnel outside the GRÚAS SÁEZ, S.L. organisation, without authorisation from the latter.
c) Misuse, neglect or non-compliance with the Seller’s operating and maintenance instructions.
d) Operation in extreme weather or geographical conditions without prior written authorisation from the Seller.
e) Alterations in the quality of the electricity supply.
f) Force majeure events, such as fire, flood, vandalism or natural disasters.
g) Use of the crane after a defect or breakdown has been detected without notifying the Seller.
h) Improper storage or prolonged exposure to weathering.
i) Damage caused during transport or by the carrier.
5. LIMITATION OF LIABILITY
The Seller shall not be liable to the Buyer or any third party for any indirect, incidental, consequential, or punitive damages, nor shall the Buyer be liable under this warranty for any loss of profits, business interruption, damage to property or claims from any third party. The Seller’s maximum liability under this warranty shall be limited to the value of the defective part which is the subject of the claim. This warranty is in lieu of and excludes all other warranties, express or implied, including those of merchantability or fitness for a particular purpose, which are expressly excluded to the fullest extent permitted by law.
6. ASSIGNMENT
This warranty is personal and non-transferable and applies only to the original Buyer and the Buyer’s position under this warranty may not be assigned to any third party without the prior written consent of the Seller. Any such attempted transfer or assignment without such authorisation shall be null and void.
7. TECHNICAL ASSISTANCE PROCEDURE
This procedure is known to the Buyer, as it is available to them in the crane maintenance book received with the crane,
and the Buyer must scrupulously comply with its contents for any procedure based on this warranty.
